ABSTRACT

In this chapter, it is important to distinguish at all times between the collection of: • contentious costs; and

• non-contentious costs. For the purposes of the collection of solicitor’s costs, a contentious matter is defined as business done in or for the purposes of proceedings begun before a court or before an arbitrator appointed under the Arbitration Act 1950, other than non-contentious probate business (see s 87 of the Solicitors Act 1974). Thus, some litigation matters will still be classed as non-contentious business if proceedings have not been issued. Further, some tribunal work, for example, employment tribunal work, is classed as non-contentious business.
