ABSTRACT
In deciding whether to make a non-molestation order, the court must have regard to all the circumstances, including the need to secure the health, safety and well being of the applicant and/or any relevant child. The applicant is thus required to show that his/her health, safety and well being have been affected by the respondent in some way.
