ABSTRACT
The hardship and section 10 defences are not available to respondents in nullity proceedings. Nullity petitions are, however, occasionally defended. The procedure is the same as the defended divorce procedure, beginning with the notice of intention to defend in the acknowledgment of service, then, the filing of an answer (and crosspetition where required).
