Experts and Assessors

The adversarial nature of expert evidence in litigation is abolished, and now the expert's primary duty is to help the court, and to override any obligation to those who may have instructed or paid him. Rule 35.1 demands that:

Expert evidence shall be restricted to that which is reasonably required to resolve the proceedings.
