ABSTRACT

The powers of a court are territorially limited; their judgments have no effect beyond the jurisdiction in which they are given unless other countries agree to accept them.

A person who has obtained a judgment from a court of one system may wish that judgment to be recognised or enforced in another. Recognition alone, without any further action to enforce the judgment, may be sought when, for example, a defendant has been found not liable in an action brought by a plaintiff in one jurisdiction and wants to stop the plaintiff trying again in an another, or a party may want his divorce or nullity decree granted in one country to be recognised in another so that he can remarry there.
