Thus, the Rome Convention will apply not only to contracts with Contracting States, but it will also apply to contracts that have no connection with the European Community save that the litigation arising from the contract has been commenced in a Contracting State. Thus, a contractual dispute between a Japanese resident and a Californian resident that is litigated in England will be subject to the Rome Convention.
