ABSTRACT

Star Fruit Company v Commission Case 247/87 Star Fruit, a Belgian trader dealing in bananas, believed that a French regulation was contrary to Community law and asked the Commission to take action against France. When the Commission declined to deal with the issue, Star Fruit sought judicial review under Article 232 EC (ex 175), arguing that the Commission’s failure to commence action under Article 226 EC (ex 169) was a failure to act.
