Société Anonyme Cimeneries and Others v Commission (Re Noordwijks Cement Accord) Cases 8-11/66 Held A registered letter sent by a Commission official to an applicant was not an opinion, as argued by the Commission, but had the effect of a Decision and was, therefore, amenable to judicial review proceedings under Article 230 EC (ex 173). The letter stated that the company’s immunity from fines was at an end and, accordingly, the Court stated that it had legal effect because it changed the legal position of the company.
