ABSTRACT

Nold KG v Commission Case 4/73 N, a German coal wholesale company, challenged a Commission Decision under the ECSC Treaty. The Decision made it impossible for N to purchase coal from his supplier, because he could not fulfil the prescribed minimum purchase requirements. N claimed that the Decision, by depriving the company of direct supplies, violated its right to the free development of economic activity.
