ABSTRACT
Cundy v Lindsay (1878) HL Blenkiron were a well-known and respected firm who carried on business at 123 Wood Street, Cheapside. A rogue, called Blenkarn, from 37 Wood Street, impersonated the neighbouring firm and ordered a quantity of linen from Lindsay. Lindsay sent the linen on credit believing that they were dealing with the firm, Blenkiron. Blenkarn (the rogue) then sold some of the linen to Cundy. Lindsay brought a claim in conversion against Cundy.
