ABSTRACT

A proviso is something which is included in an Act of Parliament to make certain that the Act does not have the particular effect that it might have if the proviso were not included in the Act. The proviso may be inserted in the Act, for example, to preserve existing rights. It may be inserted to make sure that certain rights of the Crown are not affected by a section which does affect rights of the Crown to some extent. It may be inserted in the Act to create exemptions from the section to which it is a proviso.
