ABSTRACT

In conferring various powers on administrative agencies by statute, Parliament will usually find it necessary to prescribe various procedures which should be observed in the exercise of those powers. Procedural requirements will be found either in the statute itself or perhaps in statutory rules or regulations made under the authority of the statute or some other related statutory provision. On some occasions the court may prescribe that where the statute is silent on matters of procedure or where there is an inadequate procedure, common law rules of natural justice will be implied. These are essentially rules of fair procedure which, if broken, may render the resulting administrative action ultra vires. The rules of natural justice have also been applied to the non-statutory procedures of purely domestic organisations like trade union disciplinary committees.
