ABSTRACT

Whereas Chapter 9 was concerned with the scope and legal implications of procedures defined by statute, the present chapter is concerned with common law rules of fair procedure. These rules are developed by the courts and applied to certain functions of statutory administrative agencies and non-statutory domestic organisations. In broad terms, the rules of natural justice require that no person should be judge in his own cause (the rule against bias) and that a person whose rights may be affected shall have a reasonable opportunity of being heard.
