ABSTRACT

The main defences include self-defence, necessity11 and force majeure.12 Any negligence on the part of the plaintiff can reduce compensation proportionately. The other defences generally oust the plaintiff’s claim altogether. It is possible, however, for a plaintiff to be held 100% contributorily negligent.
