ABSTRACT
The parties may in theory agree to extend the limitation period either expressly or impliedly to no overall maximum, but it is rare for defendant insurers to agree to this. The courts do not have the power to extend the limitation period, except where the plaintiff is constrained in some way that prevents him from meeting the deadline.16
