ABSTRACT

In Switzerland, service is made by the court and not by the parties. There is no procedural time limit concerning commencement of proceedings, but a claim can be time barred by the statute of limitations. Article 60 of the Swiss Code of Obligations (CO) stipulates the time limit as being one year from the date at which the plaintiff received knowledge of the damage and of the identity of the person liable for it, and, in any event, within 10 years of the damage actually being caused.
