ABSTRACT
It is an established principle of litigation that prior to trial each party has access to all the evidence which is to be used in the trial. This procedure is known as discovery. However, when one of the parties to the action happens to be the Crown, special rules apply to enable the Judge to order that documents should not be used where disclosure would be contrary to the public interest.
