ABSTRACT

It is part of the law and custom of Parliament that an Act may be altered, amended or repealed in the same session in which it was passed. This was reflected in s.10 of the Interpretation Act 1889.55 The principle is embedded in the assertion that Parliament as the legislative arm of government is the supreme legislative authority. Incidental to this is the power to change, modify or abrogate the law. Hence the principle that a present Parliament cannot fetter the hands of a subsequent Parliament. A provision in an Act of Parliament forbidding Parliament to amend that self-same Act would be void.
