ABSTRACT
All contracts give rise to legal obligations for all parties concerned; contracts in relation to sales across national boundaries are no exception to this rule. The terms and conditions of contracts are determined by the parties themselves. Under English law, the parties’ freedom even in relation to the governing law of the contract is unfettered,1 unless limitations on their freedom to contract about certain matters or with certain jurisdictions have been imposed by the governments concerned on the grounds of public policy.
