ABSTRACT

In Chapter 3 the basic rules of drafting pleadings were illustrated in the context of a simple personal injury claim arising out of a road traffic accident. In that case, a pedestrian, Jane Brown, alleged that a car driver, Paul Smith, had breached the duty of care he owed her as a fellow road user by driving in a way which caused the accident in which she was injured. The claim that was pleaded was therefore framed in negligence.
