A Claim Under the Occupiers’ Liability Act

This Act of 1957 gives a visitor a statutory right to claim damages for personal injury from the occupier of premises. Because this is a negligence claim based on statute, there is likely to be less legal argument about the duty owed to the visitor, and, in this Act, the duty of care and the defences to this duty are set out in the Act.
