In these circumstances the person depositing plans must have previously requested the council to pass plans subject to conditions or have agreed with the council that they may do so.
When passing plans the council is to state that it operates only for approval under the building regulations and any section of the 1984 Act that expressly authorises the council in certain cases to reject plans.
