ABSTRACT

This chapter assesses the measures that have been adopted by the Council of Europe concerning the rights of victims of crime and analyses the way in which the European Court of Human Rights (ECtHR) has interpreted the European Convention for the Protection of Human Rights and Fundamental Freedoms 1950 (ECHR) to include victims’ rights and interests. In addition, it evaluates the approach that has been taken to victims’ rights in English law and policy, and considers the extent to which the jurisprudence of the ECtHR has been followed by the English courts.
