ABSTRACT
Section 1 of the Partnership Act (PA) 1890 states that ‘partnership is the relation which subsists between persons carrying on a business in common with a view to profit’.
Simply receiving a payment from profits is not sufficient automatically to make a person a partner in a business concern.
