ABSTRACT

Clause 6 of the ITCH(95) and its counterpart, cl 4 of the IVCH(95), provide cover not only for some of the traditional perils of the old SG Policy,1 but also for other perils some of which are excluded by s 55(2)(c), for example, ‘any injury to machinery not proximately caused by maritime perils’.2 Clauses 6.1.6 and 6.1.8 of the ITCH(95) insuring against loss of or damage to the subjectmatter insured caused by ‘contact with land conveyance, dock or harbour equipment or installation’3 and ‘accidents in loading and discharging or shifting cargo or fuel’4 respectively can by no stretch of imagination be said to arise from a marine peril.5 With the exception of barratry, the same holds true for the other losses enumerated in cl 6.2.
