ABSTRACT

Section 30 of the 1994 Act enables the prosecution to ask magistrates’ courts to reconsider a decision to grant bail for a non-summary offence provided fresh information is available. If the court so decides, it may either remand the defendant in custody, impose conditional bail where it previously granted unconditional bail, or vary any existing bail conditions already imposed. Section 30 goes on to provide that defendants can make representations against any such decisions which the magistrates must consider.
