ABSTRACT

Schedule 3 of the Constitution of Solomon Islands 1978, which is still in force, provides:

The Western Pacific (Courts) Order 1961 (UK), which applied to British subjects and optants in New Hebrides from 1961 to 1975, provided:

Although this sub-section was revoked by the New Hebrides Order 1975 (UK), s 11 of that Order provided that the High Court of the New Hebrides established by that Order was to exercise its jurisdiction as if s 15(1) had not been revoked. The 1975 Order was itself repealed by the New Hebrides Act 1980 (UK) at the time of independence, but the principles of common law and equity have been continued in force by Art 93(2) of the Constitution of Vanuatu in 1980 as part of the British laws existing at the time of independence, until revoked by Parliament.
