ABSTRACT

Implied covenants are those that are incorporated within a legal lease unless otherwise agreed. They may be implied by virtue of a statutory or a common law provision.

Covenants that are implied by statute or common law may be implied because the parties intended them, but did not express them, or because the law requires them to be implied whether the parties intended them to be implied or not, but are needed to give the contract ‘business efficacy’.
