ABSTRACT

A licence is a mere permission to enter or use land. Most importantly, it does not give an interest in land, but merely prevents a person’s entry or use of the land from being a trespass.

A dispensation or licence properly passes no interest, nor alters or transfers property in anything, but only makes an action lawful, which without it would be unlawful (Vaughan CJ, in Thomas v Sorrell (1673)).
