ABSTRACT
The provisions regarding the definition of special procedure material are contained under s 14 of PACE. As mentioned above, such material includes that of a journalistic nature, but which is not continuously held in confidence (or the material may not be in the prescribed form required under the Act). The second type of special procedure material is that which is not legally privileged or excluded material, but which is in ‘the possession of a person who acquired or created it in the course of any trade, business, profession, or other occupation or for the purposes of any paid or unpaid office’ and holds it in confidence.
