ABSTRACT

If the assets of the estate are insufficient to pay all the debts and liabilities (including funeral, testamentary and administration expenses), the estate is insolvent (s 421(4) of the Insolvency Act 1986). The debts must be paid in the order set out in the Insolvency Act 1986 and the Administration of Insolvent Estates of Deceased Persons Order SI 1986/1999.
