ABSTRACT

When a couple divorce, there are often very complex financial implications. The court has wide powers to order maintenance pending suit (s 22 MCA 1973), although it is usually quicker and cheaper to go to the magistrates’ court under the DPMCA 1978 until the ancillary relief can be sorted. The long-term financial solutions are provided by the powers in ss 23 and 24 MCA 1973, which are exercised in accordance with the principles in s 25 MCA 1973.
