Resulting Trusts

Resulting trusts differ from express trusts because they arise through a legal presumption as to the intention of the settlor. In Re Vandervell’s Trusts (No 2) (1974), a distinction was made between two types of resulting trust: • an automatic resulting trust; and • a presumed resulting trust.
