ABSTRACT
It is sometimes necessary to determine whether real or personal property has been effectively assigned. Two common situations where this arises are where a person’s assets need to be determined for the purposes of bankruptcy or taxation; and where a person dies just after trying to make a gift and a decision is required as to whether the property remains an asset of the estate or goes to the intended party.
