ABSTRACT

Within today’s complex world, driven principally by market forces, the demands on public administration have grown tremendously. Demands for fairness in administrative procedure, appeals for the rational exercise of discretion, the need for a credible system of efficient remedies against abuse of power, and the drive for transparency and accountability in government all speak to a process of continuing reform of the machinery of government. This chapter thus proceeds on the not unreasonable assumption that the constitution is but a promissory note to the people. It remains ‘legal tender’ for as long as State authorities and institutions keep up with the peace of societal aspirations and advancement.
