ABSTRACT

The main occurrences, which will cause the failure of a devise or bequest in a duly executed will, are: • ademption of the gift; • the death of a beneficiary before the testator; • annulment or dissolution of the marriage between the testator and

the beneficiary; • the unlawful killing of the testator by a beneficiary; • the witnessing of the will by a beneficiary or his spouse; • disclaimer of the gift by a beneficiary; • abatement of the gift; • uncertainty as to the subject matter of the gift or the intended

beneficiaries; • non-fulfilment of the terms upon which the gift was made.
