ABSTRACT

The object of this paper is to present a brief yet up to date account of the international influences affecting Australian commercial law. This is so that we might gain an appreciation of the extent to which commercial law is being internationalised just as the Australian economy is being integrated into the world economy. To this end, I have selected a number of discrete topics that I hope demonstrate the breadth of the forces that are impacting modern Australian commercial law. By necessity, the ‘snapshot’ which I present is both synoptic as well as selective. What I particularly want to highlight are the individual forces and phenomena that I believe are proving instrumental in shaping the evolution and development of modern commercial law, both transnationally and within Australia itself.
