If loss is established during the relevant period, what is the defendant’s responsibility for it?

If the action is brought in tort, this will be a pure question of fact revolving around whether or not the defendant took reasonable care of the goods while in its custody. If the action is brought in contract, the terms of the contract of carriage need to be considered as these may afford a defence to the defendant. These terms may be express, implied or statutory.
