The court has held that this article can protect against excessive aircraft noise,464 and did actually apply to fumes from a waste disposal plant where the state had failed to take action.465 Compulsory blood tests for paternity proceedings were considered incompatible in principle with this article, but were held necessary for protection of the rights of others.466 In Costello-Roberts v UK 1993,467 the court held that corporal punishment in a private school was not in the particular circumstances an invasion of privacy. In Dudgeon v UK 1981,468 the court took the view that a criminal prohibition of consensual homosexual acts between males under 21 (but not over) was justifiable under para 2 as being for the protection of morals.469
