ABSTRACT
This subject can only be dealt with in outline, as in France and Germany it is regarded as forming part of the law of property, and it raises complicated issues about the nature of rights. We are considering here ‘real’ rights or rights in rem. These expressions are not synonymous, but they mean roughly the same thing: rights over things, which are enforceable against anyone.
