ABSTRACT
The European Community Directive 93/13 on Unfair Contract Terms now sets out common rules on this subject.436 It should have been implemented by 31 December 1994. It has been implemented in the United Kingdom by the Unfair Contract Terms in Consumer Contracts Regulations 1994 (made under s 2(2) European Communities Act 1972) which came into force on 1 July 1995.437 A French law of 10 January 1978438 was amended by a law of 1 February 1995 to comply with the Directive.439 The German General Conditions of Contract Act, 1976, was amended on 25 July 1996 to implement the Directive.440
