ABSTRACT
Both kinds of magistrate are appointed by the Lord Chancellor. Magistrates’ courts deal with summary offences and some offences which
are triable either way. Usually the maximum penalty which may be imposed is a fine of £5,000 or six months’ imprisonment. If the court, having heard a case, considers that its powers of punishment are in the circumstances insufficient, it may refer the defendant to the Crown Court for sentence.
