ABSTRACT

In Ex p Madden,17 the Police Complaints Board adopted a policy that it would not recommend disciplinary proceedings to be taken against police officers if the Director of Public Prosecutions had decided that there was insufficient evidence to justify prosecution. The court held that this was unlawful; the Board was set up to consider complaints and should not treat as binding the decisions of another person or body. (b) Where an independent public body takes into account government policy

in reaching a decision. This is particularly important in relation to nondepartmental government bodies, including regulatory public bodies such as Oftel, Ofgas, etc. A particular theme of the cases is that there has been government pressure to influence public sector borrowing.
