ABSTRACT

The judicial branch is governed by Chapter III of the Constitution. The courts which are governed by this part of this Constitution are thus frequently referred to as ‘Chapter III courts’. Section 71 of the Constitution vests the judicial power of the Commonwealth in: • the High Court of Australia; • such other federal courts as Parliament creates, for example:

• such other courts as Parliament invests with federal jurisdiction, which power has been used by Parliament to vest the jurisdiction to hear Commonwealth matters in State Supreme Courts.
