ABSTRACT

Where a judgment or order has been drawn up by a party and is to be served by the court, the party who drew it up must file a copy and sufficient copies for service (r 40.4). The court may also order a judgment to be served on the party, notwithstanding that he is represented by a solicitor (r 40.5), although such an order is only likely to be made in exceptional circumstances, for example, where a penal notice has been attached.
