ABSTRACT
An application for costs may be made by a defendant under r 25.12. It must be supported by written evidence (r 25.12(2)). Although the provision is only available to defendants, a claimant could apply for security for costs under rr 1.2(a) and 3.1(2)(m). Such an application by the claimant is likely to succeed only in exceptional circumstances.
