ABSTRACT
In some cases, a party will have no prospect of succeeding in bringing or defending an action and in those circumstances, it will be open to their opponent to apply, or for the court, acting on its own initiative,1 to dispose summarily of an issue or issues, or sometimes the whole case, without the need for a full trial.
