ABSTRACT

There are various ways in which the examiners could test you in this area. These are as follows:

• A problem scenario requires you to explain the various provisions of the Act. This could test, for example:

° the duty of good faith under ss 28-30; ° the duties of partners inter se: s 24; ° the liability of partners to third parties: ss 5, 6,

7, 9 and 14; ° retirement of the partners: s 36; ° dissolution of the partnership: s 44; ° Ascertaining whether property is partnership

property or whether it belongs to a partner: ss 20 and 21.
