ABSTRACT

The office of a trustee or fiduciary reflects a variety of onerous duties on the trustee or fiduciary. Far from receiving gratitude from the beneficiaries, the trustees may be subject to claims by beneficiaries for breaches of trust. See Williams v Barton (above, p 326). In performing their duties, the trustees are required to act honestly, diligently and in the best interests of the beneficiaries. Thus, the trustees are not entitled to show favour to a beneficiary or group of beneficiaries but are required to act impartially and in the best interests of all the beneficiaries.
