ABSTRACT

The philosophy for taxing such trusts is totally different from interests in possession trusts. Instead of attributing the fund to one of the beneficiaries, it is the settlement itself which is the taxable entity for inheritance tax purposes. Accordingly, the trustees are required to keep a record of chargeable transfers made but the settlement is taxed at the lifetime rates as it never dies.
